Military Green

Military Green - Most people join the military by enlisting in one of its branches. Enlisted members make up most of the military workforce. They receive training in a job specialty and do most of the hands-on work. Usually, you'll sign up for four years of active duty and four years inactive.

After you've completed your active duty time, you can either extend your contract or re-enlist if you want to continue serving. The service has established guidelines for the permanent wear of the non-subdued National Guard Identification Badge on the AGSU for those who have served in the National Guard Bureau for more than a year, Sanders said.

The Navy is part of the DOD. It protects waterways (sea and ocean) outside of the Coast Guard's jurisdiction. Navy warships provide the runways for aircraft to land and take off when at sea. Navy SEALs (sea, air, and land) are the special operations force for this branch.

Requirements For Joining The Military

All service members are known as sailors. The reserve component is Navy Reserve. "With the implementation of the Army Green Service Uniform, which is extremely important as we try and shift our culture and pay respect to the World War II generation, that really prompted the [update] to occur," Sanders said.

You must have a high school diploma or a GED to enlist. The services accept only a small number of people with GEDs each year. You can increase your chances of qualifying with a GED by:

"Sometimes, we go to certain locations, and we don't plan on that to be hostile conditions, but it may turn hostile," Sergeant Major of the Army Michael Grinston said. "How do we recognize those soldiers who are out doing what we have asked them to do? ... So we allow them to wear the shoulder sleeve insignia for the unit. I think that is appropriate."

Officers make up a much smaller part of the workforce. To join as an officer, you typically must have a four-year college degree and complete an officer program. Most officers are managers who plan and direct operations.

Steps For Joining The Military

Others are professionals like doctors and lawyers. Officers get paid more than enlisted members and enjoy certain other benefits. The Army is part of the DOD and is the largest of the military branches. It handles significant ground combat missions, especially operations that are ongoing.

Army Special Forces are called Green Berets for their headgear. The Army's members are its soldiers. The reserve components are the Army Reserve and Army National Guard. The Marine Corps is part of the DOD. It provides land combat, sea-based, and air-ground operations support for the other branches during a mission.

This branch also guards the U.S. embassies around the world and the classified documents in those buildings. Marine Corps Special Operations Command (MARSOC) members are known as Raiders. All service members are called Marines. The reserve component is the Marine Corps Reserve.

The Air Force is part of the Department of Defense (DOD). It's responsible for aerial military operations, defending the U.S. air bases, and building landing strips. Its service members are airmen. The reserve components are Air National Guard and Air Force Reserve.

The AR 670-1 update also authorizes female soldiers who breastfeed to wear an optional undershirt designed for nursing. Service officials said in November that the Army Uniform Board will consider developing a lactation shirt for the Maternity Utility Uniform in the Operational Combat Pattern.

The Shoulder Sleeve Insignia Former Wartime Service will now be called the Shoulder Sleeve Insignia Military Operations in Hostile Conditions. It is authorized for soldiers who served on combat deployments to Iraq and Afghanistan, but also those who served in certain countries considered hostile areas.

The U.S. military has six branches of service: the Army, Navy, Air Force, Coast Guard, Marine Corps, and Space Force. The requirements to join are similar for all six. The main differences are in age limits, test scores, and fitness levels.

Men and women meet different fitness standards. Besides the requirements listed here, a branch may have other requirements. Start by doing some research about your options for joining the military. Learn about the six active-duty branches and their part-time counterparts.

If you're interested in more than one branch, contact a recruiter for each. If you're interested in joining as an officer, the recruiter will explain any options you may be eligible for. "It's been almost five years since we made an update, so it was definitely time. There [have] been a lot of changes; we have ... added new uniforms," Sgt.

Maj. Brian Sanders, Army G-1, Uniform Policy Branch sergeant major, told reporters at a roundtable. The Space Force is a new branch, created in December 2019 from the former Air Force Space Command. The Space Force falls within the Department of the Air Force.

It organizes, trains, and equips space forces to protect the U.S. and allied interests in space and provide space capabilities to the joint force. The Coast Guard is part of the Department of Homeland Security (DHS).

It provides national security and search and rescue for America's waterways, seas, and coast. It is responsible for stopping drug smugglers and others breaking maritime law. It enforces marine environmental protection laws. Service members are Coast Guardsmen and nicknamed Coasties.

The reserve component is the Coast Guard Reserve. If you decide to enlist, you will report to a military entrance processing station (MEPS). You'll spend a day or two completing pre-enlistment steps. These include taking the ASVAB, having a physical exam, meeting with a career counselor, and if you're accepted, taking the oath of enlistment.

From there you'll receive orders for basic training, usually to start within a few weeks. If you enrolled in a delayed entry program, you'll go home and get orders for basic training within a year.

14 Military Time

14 Military Time

14 Military Time - If the 12 hour time is in the pm, we will add 12 hours and remove the “pm”. For example - 2:30 pm, here we add 12 hours to the hours section (2 + 12 = 14) and we get the military time of 14:30 hours.

Standard and military time express minutes and seconds in the same format. For example, 20:20 military time is 8:20 p.m. using a 12-hour clock notation. It is 20:20 (spelled out using two-zero-two-zero) using a 24-hour clock notation.

Thus, 20:20 military time means that it has been 20 hours and 20 minutes since last midnight. Using the military time converter is simple. If you wish to convert standard time to military time, enter the hour in the first box and the minute in the second box.

Are Minutes And Seconds Counted Differently In Military Time?

Select if it is a.m. or p.m., then click “Convert.” To convert from military time to regular time refer to the time chart below or follow these steps. If the standard time is in the am (before 12:00 pm, noon), simply remove the “am”.

If the hours portion is a single digit, in our example it is a single digit “9”, we will add a “0” before the “9” resulting in “09”. This is because the 24 hour military format must always have 2 digits for both the hours and minutes sections.

For instance, 2:15 am becomes 02:15 hours. To convert from regular time to military time refer to the time chart below or follow these steps. The 24-hour clock, also known as military time, tells time by dividing the day into 24-hour increments, numbered 0000 to 2400. Military time differs from standard time, which uses numbers 1 through 12 and an a.m./p.m.

designation to indicate time. To convert military time to standard time, take the number of hours and subtract 12. For example, 1300 = 13 hours. Take 13 – 12, which equals one or 1:00 p.m. For 1400, it's 14 – 12, which equals two, or 2:00 p.m.

Keep in mind this only applies to time after 1200 hours. The 24-hour clock is common in other countries for the same reason the U.S. the military uses it: it prevents ambiguity and confusion, especially in high-stress environments.

How To Convert From Military Time To Regular Time

In many countries, the 24-hour clock is the primary method of telling time. We all may not be soldiers, but it's admittedly cool to hear a soldier talk in military time. So it's not 4 o'clock in the afternoon anymore.

Use this military time converter and invite your friends over at 1600 hours! For more information about military time (army clock) and military time conversions, check out our Military Time Chart below. If you're converting standard time to military, it's the opposite.

Add 12 instead of subtract, and you'll have military time. For example, 4:00 p.m. to military time is 4 + 12, which equals 16, or 1600 hours. For a military time that is larger than 12:00, just subtract 12 hours to get the 24 hour (standard time), then add "pm".

For example, if you have 14:30 hours, subtract 12 hours and the result is 2:30 pm. Veteran.com is a property of Three Creeks Media. Neither Veteran.com nor Three Creeks Media are associated with or endorsed by the U.S.

Military time is a method of timekeeping based on the 24 hour clock. It relies on a day that is divided into hours and minutes on a 24-hour cycle from midnight to midnight. Military time is commonly used in the United States, United Kingdom, Philippines, Canada, Australia, New Zealand, India, Egypt, Saudi Arabia, Columbia, Pakistan, and Malaysia. The 24-hour time system is primarily used by military and emergency services in these countries, unlike the rest of the world. Civilian timekeeping in these countries primarily uses the 12-hour timekeeping system notated with A.M. and P.M. Most other countries in the world use a variation of military time called 24-hour time for both civilian and military timekeeping.

This system is used to convey accurate time across time all zones, countries, and languages. Military time turns all time calculations into a four-digit number and removes the need for the AM or PM suffix. It is used most famously by the military in the United States, but it has also been adopted by many other agencies and services. Examples include emergency response teams, hospitals, aviation, navigation, and anywhere else where time confusion can have a serious or negative impact.

Military Time Chart With Time Zone Name

A military time chart is designed to offer an easy method for finding the link between standard time measurement and military time (or the standard 12-hour time system and the military’s 24-hour time system). The military time converter chart above is a simple conversion table with standard time on the left column and its corresponding military time on the right. In most cases, it should be presented without the colon separator between minutes and hours. As such, it is not present in the military time chart above.

If you want to convert military time to 24-hour timekeeping, then you would simply add the colon between the middle two numbers (ex. 1834 to 18:34). Military time can also be known as army time, navy time, marine time, and even air force time.

Military Memes

Military Memes - If there is one thing that Army soldiers are known for, it's handling a lot of stress. So a college final may not be as stressful for them compared to the average student. Yes, you can study for them for as long as possible.

And the difficulty can be stressful to say the least. Flew a plane recently? Didn't like the leg room? Ah...the Army has seen worse. In fact, these military planes make leg room on a commercial flight look a lot more generous.

Military Memes

Military Meme Monday — April 9 Edition

Not to mention, those seats look kind of uncomfortable. So maybe spending $150 on a flight may not seem so bad. When the new recruits step off the bus for basic training, the first person they are greeted by is none other than a drill sergeant.

Finals Are Stressful? That’s Cute – Funny Army Meme

They are inches away from your face and yelling at you to "do this" or "do that". For some, it can be a scary experience (and scare you straight). While discarded rounds are not fun to pick up after some serious firing at the range, why not make the best out of a crappy situation.

20 Funny Army Recruiter Memes For High Schoolers In 2023

This soldier right here decided to make a 'freedom angel'. However, this is not an ideal winter weather situation to be going this way. It's a dirty job, but someone's got to do it. This soldier learned the hard way.

It's true that those who join our military have sworn to protect the freedom of our country against all enemies. However, things can happen at an Army Barracks (especially at a latrine on base). We're not sure if it was mud or not.

But this photo makes for a great meme between enlistees of the Army and the officers who lead and command. The enlisted Army members are lower ranked, so whatever the commanding officer says goes. If you're a former Soldier, you might have some stories about doing some grunt work as an enlistee.

Airline Seats – Great Army Meme

Our next military meme may not apply to just the Army, but any other branch that wears camo gear. Imagine that not working to your advantage except your grandma's couch (which looks exactly like the camo you wear).

So why not get your grandma to send the couch to your base or wherever you are doing combat training? You'll blend in quite nicely it seems. The enemy won't see you coming, even when they decide to sit down and relax.

A hilarious Army meme! Our first Army meme kicks off with a bang. There is no denying that the Army loves to get down and dirty (especially in the mud pits of the obstacle course during basic training).

Spartan On Twitter:

Yet, they are not afraid to get a little wet when they are outdoors. This next to last military meme speaks a lot of truth. A lot of us complain about that "hard day" of work.

It Was At This Moment…Funny Army Meme

For the Army, they work long hours. And they are mostly in stressful situations (especially when they are combat-related). So it's always important to give them their thanks. There's always a running joke where lieutenants don't have a clue what they're doing (or where they're going), even with a map.

Unfortunately, for this group of soldiers, what appeared to be a harmless mud puddle ended up being something more. And their humvee since to the bottom of what appears to be a mud pit. Casual Friday at any workplace is typically a t-shirt and jeans at the office (as opposed to the usual attire).

Sdl On Twitter:

But for one soldier, it seems that he takes it a little too far. He's got his helmet and his backpack. However, he decides that today might have been the day to show up for work wearing a t-shirt and boxers.

The Army maintains a high standard of cleanliness and attention to detail. And no drill sergeant wants to see a train wreck unfold before their eyes. Unclog that and give me twenty. Another funny Army meme up next…

Freedom Angels – Hilarious Army Meme

The Army Rangers are known for leading the way. But according to this Army meme, it might not go the way that it's planned. Especially when one ranger forgets to move a certain piece of equipment from his rifle while he's on the move.

Funny Military Memes, B.s., And Shotgun Club! | Page 185 | Tacoma World

All jokes aside, the Army Rangers are hands down one of the best fighting forces in the military. If there is one thing that can get someone on the bad side of an Army wife, it's taking the words 'sweep the house' out of context.

When soldiers sweep the area, they are searching for threats that may be in the area. But frustrating as it is, the wife will ask 'what are you doing' when you're in full combat gear and your rifle is out and about.

In an homage to one of the most iconic lines of the movie 'Titanic', the Army decided to take it upon themselves to make their own version. Three soldiers working together when one of them decides to re-enact the scene.

Join The Army They Said…

Before the Army does anything, they request permission such as to 'speak freely' and the like. In the Army, they are taught to learn and respect their rifles (and other weapons). While a machete may not be a weapon for soldiers, it can be used for something useful like cutting through thick vegetation and the like.

This daredevil soldier looks like he's about ready to catch this blade after tossing it around. But it looks like he's going to catch it on the wrong end. Talk about a trick gone wrong. Time for the safety briefing on how NOT to handle sharp objects.

Military Macaw - The three subspecies of the Military Macaw are distinguished geographically. The ‘Ara militaris militaris’ are often found in areas of Peru, Ecuador, Colombia and Venezuela. The ‘Ara militaris mexicana’ occupy areas in Mexico and the ‘Ara militaris boliviana’ live in Bolivia and Argentina.

According to the IUCN Red List, there is thought to be between 10,000 and 20,000 individuals across its range, though the website acknowledges other lower estimates of less than 10,000. The home range of Military macaws is large, due to the fact that they will fly miles from their roost to forage for food.

If you are interested in having a macaw as a pet, do extensive research before deciding. They are long-lived birds, and may outlive many humans. They require lots of stimulation, enrichment, and attention. If you are determined in getting a macaw or other parrot, please consider getting a rescued bird as opposed to a young/baby one to avoid the risk of getting one that was smuggled from the wild (a very traumatic experience for birds) and supporting the illegal pet trade. The Oakland Zoo is a conservation partner to Mickaboo Companion Bird Rescue, a good organization to adopt from.

Military Macaw Reproduction

The three subspecies of Military Macaw breed at different times. However this probably has more to do with the geographical region they are residing in than anything else. Breeding in the militaris species occurs from January to March. The mexicana species breeds from April to July and the boliviana species breeds in November and December.

There is significant variation in the breeding season across the entire range of the Military macaw. Temperature could be a factor, but food availability may also factor in, as fruits are only available part of the year.

At first glance, these parrots may not be as striking as some of their cousins, but these parrots are beautiful nonetheless. They are fun-loving and sociable, and many of those kept as pets have distinguished themselves as excellent talkers.

Are Military Macaws Good For Beginners?

As a generally well-tempered macaw, a military macaw can be a good first bird for beginners, though a smaller parrot, such as a parakeet (learn more here), is usually recommended for those with no avian experience.

Military Macaws are monogamous and remain with their mates for life. As they fly around in large flocks, the mates/pairs will fly together. They will also be found flying in pairs in their feeding and roosting/nesting areas.

The Military Macaws (Ara militaris) received their name when they were first imported into Europe by military personnel; also some suggest that this species was named for the overall “army or olive green” color of its plumage.

Militaries do well in a large macaw cage as an indoor pet. They enjoy toys, especially wood items that they can chew. They are quite capable talkers and can be easily trained, including being potty trained to the cage.

Hahn’s Macaw

According to the American Federation of Aviculture, Hahn’s macaws are the world’s smallest macaw parrot. Hahn’s macaws are also known as the red-shouldered macaw because of the red feathers on their shoulder and the mini macaw due to their tiny size.

The Military macaw is one of the larger species of macaw, reaching up to 33 inches in height, including tail. It is a medium green on the crown, neck, front, upper back and wings. The forehead is brilliant red, and the flight feathers and rump is light blue. The tail is reddish above and yellow below. The cheeks are white, with small black feathers. The eyes are yellow and the beak is black. The juvenile coloration is duller, and the eyes are gray.

In the wild, scarlet macaws are found in flocks at Peruvian salt licks, where they ingest the clay from gigantic red walls. It’s thought that clay protects parrots from toxins and provides sodium and calcium when missing from a parrot’s diet.

They reach 12 to 14 inches and 140 to 165 g, making them small and light. So, Hahn’s macaws don’t need a large cage; the minimum size should be 34″ wide x 24″ deep x 36″ tall.

Military Macaw Diet

They live in pairs, in families, or in large flocks, usually roosting in the highest outer branches of trees or foraging for fruits and nuts. They are usually easily identified even out of sight by their loud screeching and croaking.

Lear’s macaws eat up to 350 nuts daily in the wild, providing them ample energy. Most macaws need more fat and oil in their diet than other parrot species because they’re more active. This would make them obese in captivity, but Lear’s macaws are rarely seen as pets.

Not only are blue-and-gold macaws physically large, but they’re also larger than life in voice and attitude. They enjoy listening to themselves, so they make lots of noise. However, they’re also popular pets due to their loving, sensitive nature.

The Military Macaws diet consists of seeds, fruits, nuts, berries and other vegetation found on treetops in the rainforests. Their beaks are well adapted for eating various seeds and nuts as they have the ability to break open the hardest of shells with relative ease.

Ecological Web

Military macaws, as well as other parrots, are important pollinators and seed dispersers of their habitat. Thus, they can shape the flora of their habitat. They also are prey to jaguars, eagles and hawks, monkeys, and snakes.

"There are 3 subspecies of Military macaw; the nominate subspecies, A. m. militaris, is smaller than the A. m. mexicanus subspecies, and the A. m. boliviana subspecies has a red-brown throat and the feather tips on the primary feathers and tail are dark blue. A. m. militaris is found in Colombia, Venezuela, Peru, and Ecuador. A. m. mexicanus ranges along the Pacific coast in Mexico from Sonora to Jalisco, and the range of A. m. boliviana is restricted to the eastern slope of Andes in Bolivia and Argentina. The Military macaw is sometimes confused with a similarly colored and larger species, the Great green macaw (also called the Great military macaw)."

Military Macaws are now listed as Vulnerable on the 2006 IUCN Red List Category. They are also listed as CITES (Convention on International Trade in Endangered Species of Wild Fauna and Flora) Appendix I, which protects the birds from being captured for trade.

Military Macaws will leave their roosts in flocks around dawn and head to their feeding areas. They will also visit heaps of clay known as ‘macaw licks’. These clay licks are found along riverbanks or sometimes inside the Amazon rainforest. Macaws will flock to feed on these clay deposits, which appear to detoxify the poisons found in the seeds and vegetation of the rest of their diet.

Species Specifics

The Military macaw, like all parrots, has zygodactyl feet, which mean that two toes point forward and two toes point backward. This allows the macaws to grip better, which is important as they often hold their food with their feet or walk along branches rather than fly.

The plumage is mostly green, except for the red tuft of feathers on the forehead (behind the cere of the beak) , white cheek patches with tiny black feathers, bluish-red primary wing feathers, and tail feathers that are brown red above and yellow underneath.

Scarlet macaws are one of the most distinctive macaw species due to their bright red feathers. They also have light blue feathers on the rump and tail, yellow feathers on the upper wings, and dark blue feathers on the wings and tail end. The tail flight feathers have a gold tint.

The population and distribution of the Military Macaw has been decreasing over the past fifty years. The abundance of the Military Macaw has now decreased to less than 10,000 globally. This decrease is mostly due to deforestation and the capturing of wild birds for the pet trade industry.

Military Macaw Conservation Status

In the wild, their breeding season stretches from about January to March. The female can lay as many as four eggs which are incubated for about a month, 28 days before they hatch. The female is the only one who tends the eggs and the young. Captive birds readily hybridize with related species

Breeding season varies along a north-south axis; in Mexico, breeding season begins in June, in middle parts of their range it begins in summer, and in the southernmost part of the range, breeding season is in winter. Military macaws will pair for life, and will often preen and feed each other. Nests are laid on cliff faces or high up in trees. The female will lay 2-4 eggs, which are incubated for about 25-28 days. The female will incubate the eggs and brood the chicks, which hatch featherless and need parental care. The male will feed the female and later her chicks.

The average hyacinth macaw measures 40 inches from the top of its head to the tip of the tail. It also has a wingspan of 48 inches and weighs 1.2 to 1.7 kg, making it one of the heaviest parrots and the biggest.

Hi, I'm Carrie. I have a passion for all birds, but especially parrots. I’ve got a 15-year-old blue and gold macaw, a 7-year-old African grey, and a 6-year-old Senegal parrot. First-hand experience and research have taught me so much about these characterful birds. So, a few years ago, I started “all about parrots” to share my knowledge and experience with a wider audience.

Reproductive Behavior

They are probably the smallest of the large macaws at a length of 27 – 33 inches (70 – 84 cm) from beak to tail. Their wing length: 14 inches; wingspan: 39 – 43 inches; and weight: 862 – 1074g.

Is a military macaw a good pet? Military macaws can be excellent pets and will form a close bond with owners, but they do require a commitment of time and money. They are highly intelligent and typically easy to train, and they are capable of learning to speak, though not as clearly as other macaws.

In South America, it is found in humid lowland forest, gallery forest, and wooded foothills and canyons. In Mexico, the Military macaw can be found in riparian forest, arid and semi-arid woodlands, and human lowlands. Its habitat ranges in elevation from 1640 feet to 4900 feet, occasionally going higher.

Article 15 Military

Article 15 Military - Subsec. (c). Pub. L. 87–648 substituted “under subsection (b)(2)(A)–(G) as the Secretary concerned may specifically prescribe by regulation” for “to be imposed by commanding officers as the Secretary concerned may by regulation specifically prescribe, as provided in subsections (a) and (b),” and deleted “for minor offenses” after “an officer in charge may”.

Amendment by Pub. L. 90–623 intended to restore without substantive change the law in effect on Oct. 22, 1968, see section 6 of Pub. L. 90–623, set out as a note under section 5334 of Title 5, Government Organization and Employees.

Behind The Scenes |

Not every misconduct by a member of the military warrants a court martial hearing. Sometimes, commanders can issue Article 15, also known as non-judicial punishment, to soldiers who violate UCMJ regulations that do not require a trial or violate local or federal laws.

Understand Why You Have Received Article

Commanding officers also have the discretion to suspend punishments for up to one year. Effectively, this means that punishment is not carried out unless the defendant fails to comply with the terms of the suspended sentence.

They have the right to appeal if found guilty, using a copy of the trial record. The Military Rules of Evidence apply in these proceedings, so there are limits to the admissibility of evidence similar to the limits in civil courts.

In contrast to formal courts-martial, Article 15 procedures in the U.S. military are a form of non-judicial discipline conducted by commanders. They do not result in a criminal record and may not affect a service member's record in the military.

These are the most common type of disciplinary proceedings in the armed forces and are usually limited to minor violations. A more serious offense will be handled through a formal court-martial. If a service member does not want to accept Article 15 penalties, they can request a court-martial, but this may result in more severe consequences.

The Potential Penalties Of A Non-Judicial Punishment

You may want to talk to a military law attorney if you are considering requesting a court-martial instead of accepting Article 15 penalties. You can see the evidence against you before the process begins, as well as the nature of your charge and the names of your accuser and prosecution witnesses.

Article 15 of the Uniform Code of Military Justice allows a commanding officer to decide innocence or guilt and, if necessary, administer punishment to an offender when a military man gets into trouble for a misdemeanor that does not require a court hearing.

How An Article Military Works

Non-judicial punishments follow an investigation into unlawful conduct by a member of the armed forces and a hearing to determine the deserving punishment. If the commanding officer determines that Article 15 is appropriate, they will inform you of the intended action alongside any supporting evidence.

You will also be notified of your rights. Understanding the reasons behind your Article 15 action is crucial before deciding the way forward. A military service member may be able to have their record of an Article 15 violation removed if they do not commit any more violations for a certain time.

This may be two years if the Article 15 was filed at the Judge Attorney General's office on a military basis. Sometimes getting a promotion can wipe out a record of an Article 15 violation as well.

Restrictions on correctional custody, base, or other specified limits typically cannot last more than 30 days, and the range cannot be reduced more than one degree. The payment can generally be reduced to no more than half for two consecutive months.

Summary Courts-Martial

It is advisable to get experienced counsel before making the call to refuse or accept the non-judicial punishment. You may expose yourself to heavier penalties should you choose to go the court-martial way. While Article 15 will not necessarily derail your career, everything depends on making sure you have experienced legal guidance.

You can ask your commander to help you ask the FBI to remove the record of your arrest, or you can submit a request under privacy laws. As noted above, Article 15 does not give rise to a criminal record, so you should not face the same kinds of obstacles that people with convictions in civil court often face.

Military service members have a basic set of rights at a summary court-martial. They will be allowed to present witnesses and evidence, and they are free to remain silent without an inference of their guilt. They have a right to know the maximum possible sentence before the proceedings begin, and they can plead guilty or not guilty.

Tim Kennedy On Twitter:

They also have a right to make a statement or present further evidence to support a reduction in their penalties if they are found guilty. (They can ask to defer any part of their sentence that involves confinement.) They have a right to appeal if they are found guilty, using a copy of the trial record.

Impact Of Article

The Military Rules of Evidence apply in these proceedings, so there are limits on the admissibility of evidence that are similar to the limits in civilian courts. The Army and Air Force often use the term "Article 15 hearing," but the Marines call them "Business Hours" and the Navy refers to them as "Captain's Mast" or "Admiral's Mast," depending on rank.

6, 1983, see section 12(a)(1) of Pub. L. 98–209, set out as a note under section 801 of this title. Article 15 punishments are not severe compared to court-martial sentences. For instance, the custodial sentence, if any, cannot exceed eight days.

Your rank may not be downgraded by more than one grade, nor can your pay be reduced by more than two-thirds for the month in which the offense occurred. An Article 15 case may refer to a less formal type of court-martial, known as a summary court-martial.

Arrests And Civilian Consequences

If you do not want your case to be decided in summary court-martial, you have the right to reject it. You are not entitled to a free military defense attorney in summary court-martial, as you would in other types of court-martial, but you can hire a civil defense attorney if you wish.

To initiate Article 15 action, a commander must have reason to believe that a member of his command has committed an offense under the UCMJ. A minor offense is defined as misconduct that is normally no more serious than that usually dealt with in a summary court-martial and where the maximum punishment is 30 days imprisonment.

An Article 15 hearing is more of a legal proceeding than a trial and involves the chain of command with references that speak for or against the accused. By comparison, an Article 15 hearing is more similar to a misdemeanor court than a felony court, which would be more comparable to a court-martial.

If, after preliminary investigation, the commanding officer determines that the disposition by the NJP is appropriate, the commanding officer should inform the accused that the NJP is being considered for the offense, along with the contemplated action, the suspected offense.

L. 90–623 substituted "or a legal specialist or lawyer of the Coast Guard or Department of Transportation" for "or a legal specialist or lawyer of the Marine Corps, Coast Guard, or Treasury Department".

An Article 15 case may be referred to a less formal type of court-martial, known as a summary court-martial. If you do not want your case to be decided at a summary court-martial, you have the right to refuse it.

You can see the evidence against you before the proceedings begin, as well as the nature of your charge and the names of your accuser and prosecution witnesses. You can ask for a spokesperson or other service members to speak on your behalf.

However, a single officer will evaluate the evidence and make a decision. They will question both the accuser and the accused about their version of events, and they can ask for legal advice from a judge advocate if needed.

Types Of Article Punishments

A service member can have his or her history of an Article 15 violation expunged if he does not commit further violations within a specified time. This could be two years if Article 15 was filed at the Attorney General's office on a military base.

Ayushmann Khurrana Opens Up About 'White Savior Complex' In Article 15

Otherwise, a violation of Article 15 may affect your future access to security clearances, as well as your chances of getting a promotion or certain types of assignments. Sometimes getting a promotion can also erase a history of an Article 15 violation.

Non-judicial punishment is the result of an investigation into wrongful conduct and a subsequent hearing to determine whether and to what extent an accused should be punished. Typically, when a complaint is filed with an accused's commanding officer (or if that commander receives an investigative report from a military law enforcement source), that commander is required to conduct an investigation to determine the truth.

of the matter. If you were arrested during the events that resulted in Article 15 penalties, you may face consequences in your civilian life. This is because arrests may be reported to the FBI. You can ask your commander to help you ask the FBI to remove the record of your arrest, or you can submit a request under privacy laws.

As noted above, Article 15 does not result in a criminal record, so you should not face the same types of obstacles that people with convictions often face in a civil court. Imposing penalties under Article 15 in the Army and the Air Force requires proof of a violation beyond a reasonable doubt.

Imposing penalties under Article 15 in the Navy and the Marines requires clear and convincing proof, which is a lesser standard. The military has its own laws and regulations, all of which can be found at the UCMJ.

Not all violations of the rules are serious enough to require a legal hearing, so Article 15 provides an alternative to a court-martial, which is a trial with a jury made up of military officers, warrant officers, or Enlisted members, based on the

rank of the defendant.1 Amendment by Pub. L. 107–296 effective on date of transfer of Coast Guard to Department of Homeland Security, see section 1704(g) of Pub. L. 107–296, set out as a note under section 101 of this title.

The commanding officer has several options for determining punishment, but none of them can be severe. The limits on punishments may vary depending on the rank of the commanding officer and the rank of the accused.
